Count of Restraints & Seclusions

This is the total count of restraints and seclusions that occurred during the last school year. If a student was restrained or secluded more than once, each count would be included in this calculation.

This is the total number of students who were restrained or secluded one or more times during the school year.

Restraint

1 CCR 301-452.00(7) “Restraint” means a method or device that is used to limit a student’s voluntary freedom of movement. “Restraint” includes seclusion, chemical restraint, mechanical restraint, and physical restraint.

• Physical Restraint - 1 CCR 301-452.00(7)(c) For purposes of these rules, a “Physical Restraint” means the use of bodily, physical force to limit a student’s voluntary freedom of movement for more than one minute.
• Seclusion -1 CCR 301-45.2.00(8) “Seclusion” is a form of restraint and means:
  • the placement of a student
  • alone in a room or area
  • rom which egress is prevented.
• Mechanical Restraint - 1 CCR 301-452.00(7)(b) “Mechanical Restraint” means a physical device used to restrict a student’s voluntary freedom of movement or the movement or normal function of a portion of their body.
• Prone Restraint - 1 CCR 301-45.2.00(7)(d) “Prone Restraint” means a restraint in which the student who is being restrained is secured in a face-down position.

Instructional Program/Service Type

Services provided by schools and/or districts in the current year for students identified as belonging to one or more of the categories below:

• Students with Disabilities - Students who have been formally identified as having physical or health conditions that may have a significant impact on the student’s ability to learn and therefore warrant placing the student on an Individual Educational Program (IEP).
• Students with a Section 504 Plan - Student who has been identified as having a disability under regulations implementing Section 504 of the Rehabilitation Act of 1973 but may or may not be eligible for special education placement under the Individuals with Disabilities Education Act.
• Multilingual Learners - Students who have been identified as Non-English Proficient (NEP), Limited English Proficient (LEP). Non-English Proficient is defined as a student who speaks a language other than English and does not comprehend, speak, read, or write English. Limited English Proficient is defined as a student who comprehends, speaks, reads, or writes some English, but whose predominant comprehension or speech is in a language other than English.
• Economically Disadvantaged (Free/Reduced Lunch) - Student qualifies for either the free or reduced lunch program. 
• Homeless - According to the McKinney Act, a “homeless individual” lacks a fixed, regular, and adequate nighttime residence.
