Title I, Part A - Neglected Eligibility

Process for determining eligibility to receive Title I, Part A - Neglected Funds 

The following is a list of questions LEAs and facilities should answer to determine eligibility for Title I, Part A - Neglected Funds. If the LEA can answer yes to all the questions below, it is likely that the facility is eligible. 

• Are students placed in the institution under applicable State law due to abandonment, neglect, or death of their parents or guardians? [ESEA section 1432(4)(a)]  

1. Are students referred by one of the following agencies with an open neglect case?

a. Department of Human Services 

b. Division of Youth Services 

c. Regional Accountability Entity

d. LEA referral in partnership with one of the agencies listed above in a-c 

2. Do students meet the definition of Neglected as defined in Colorado State Law?

3. Are 51% or more of the students in the facility referred due to abandonment, neglect, or death of parents?

• Does the institution serve students between 5-17 years of age? [ESEA section 1124(c)(4)(B)]  Note that the institution does not have to serve students of all ages 5-17, nor does it have to serve only students ages 5-17. The institution does have to serve students within this age range.  

• Do the students live in the facility? [ESEA section 1432 (4)(a)]  

• Is the program locally operated (public or private)? Institutions for children for which a State agency is responsible for providing free public education and included in the count for Subpart 1 cannot be included in the local institution count. [ESEA section 1124(c)(1)(B)]

Once an LEA and facility have reviewed the above questions and determined that the facility might be eligible, please reach out to Nathan Hickman (hickman_n@cde.state.co.us) to schedule a meeting to review eligibility and discuss the Title I, Part A - Neglected program. LEAs and facilities should have articles and evidence that demonstrate eligibility that could include:

• Admittance criteria
• Attendance information 
• Program policies and processes 
• Partnering agencies and organizations 
• Facility licenses 
• Promotional material or public facing information 
• Education program information
